]]>The legislative tool the HEAT program uses to enforce their actions is called the False Claims Act. From the short two year period since the HEAT program has been in existence, the program has recovered more than $7.3 Billion. Although not all of that recovered money came from physicians alone, it still makes you wonder why physicians would risk so much for money alone.
For example, on June 30th a Las Vegas physician agreed to pay back $5.7 Million plus interest to settle allegations that he double billed for sophisticated oncology related services from 2007 to 2009. The complete story can be found here. Not only did the physician double bill Medicare, but also TRICARE, & the Federal Employees Health Benefit Program. Although millions of dollars seems like a lot, loosing your livelihood and profession is worth a lot more. Plus the physician who was caught not only has to pay back the money, but also has to pay back interest on top of the moneys he stole.
The press release states that: “Patients, employees, and others who suspect billing fraud on the part of doctors should not hesitate to report such fraud to federal authorities,” said U.S. Attorney for the District of Nevada Daniel G. Bogden. “Persons who file dishonest claims with the government in order to enrich themselves will be investigated and aggressively pursued by the Department of Justice.”
This means as a medical biller you must report any abuses that you see happening in the office you work in or the clients that you bill for. Stealing from tax payers is never right to do and as a medical biller you are in a position to report any legitimate fraud and abuse happening. You might be worried that you can loose your job but you are protected from the qui tam or the whistle blower provision of the False Claims Act discussed above.
